The Gabby Bernstein family of companies, including Dear Gabby, Inc., Gabby Plus, Inc., and Gabrielle Bernstein, Inc. (collectively, “we,” “our,” or “us”), provides this Privacy Policy to describe how we collect, use, and share the information of individuals who visit or interact with our website gabbybernstein.com, the Gabby Plus mobile application, and any other website or app that links to this Privacy Policy (collectively, the “Sites”).

When you use our Sites, you may voluntarily provide information about yourself, such as your name, address, email address, phone number, log-in information, marketing preferences, avatar, or other information you choose to provide.  For example, we collect this information when you join our email list, create an account, subscribe to our services or publications, provide feedback, contact us, request marketing materials, or interact with us for any other purpose.  We may also collect your mailing and billing information when you place an order with us or subscribe to our paid membership services.

digital advertising & analytics

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms.  Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and other sites or apps over time, including information about relationships among different browsers and devices.  This type of advertising is known as interest-based advertising.

You may visit the DAA Webchoices tool at www.aboutads.info to learn more about this type of advertising and how to opt out of this advertising on websites by companies participating in the DAA self-regulatory program.  If you delete your cookies or use a different browser or mobile device, you may need to renew your opt-out choices exercised through the DAA Webchoices tool.  Note that electing to opt out will not stop advertising from appearing in your browser or applications.  It may make the ads you see less relevant to your interests.

This section applies to individuals from the European Economic Area (“EEA”), the United Kingdom (“UK”), and Switzerland. 

Sometimes, we process personal information with your consent. On other occasions, we may process personal information when necessary to fulfill a contract or where required to do this by law.  We may also process personal information when it is in our legitimate interests to do this (e.g., for customer service or for safety and security purposes) and when these interests are not overridden by your data protection rights.

Personal Information We Collect and Disclose.  We collect and disclose, and within the preceding 12 months we have collected and disclosed, the following categories of personal information: 

  • Personal and online identifiers (such as first and last name, address, email address, phone number, username, avatar, or unique online identifiers);
  • Customer records (such as bank account number, credit card number, debit card number, or any other financial information);

We share personal information for interest-based advertising purposes but do not otherwise engage in “sales” of personal information as defined by state laws.  Additionally, we do not knowingly sell or share personal information of individuals under 16.

We may share all categories of personal information above, except customer records, with social networks and advertising companies and networks for interest-based advertising.

We may use and share aggregated and deidentified information to the extent permitted by applicable law.  When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it, except to check whether our deidentification processes satisfy the requirements of applicable law.

Recipients of Personal Information.  We disclose the categories of personal information designated above to the categories of third parties listed below for business purposes:

  • Affiliates or joint venture partners;
  • Service providers; 
  • Data analytics providers; 
  • Social networks; 
  • Advertising companies and networks; and

Your Rights.  Residents of certain states have rights with respect to the personal information we collect.  You may be able exercise the following rights regarding personal information, subject to certain exceptions and limitations:

  • Depending on your state, the right to receive a portable and readily usable copy of the personal information we have collected about you, to the extent feasible. 
  • The right to correct inaccuracies in the personal information we have collected about you. 
  • The right to request that we delete the personal information we have collected about you.
  • The right to opt out of the sharing of personal information for interest-based advertising.  Please note that if you opt out of certain practices, we may be unable to provide you with some services.  
  • The right not to receive discriminatory treatment for the exercise of the above privacy rights.

Additionally, for Colorado, Connecticut, and Virginia residents, if you have submitted a request that you believe we have not reasonably fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to [email protected].

Verification Process and Required Information:  Note that we may need to request additional information from you to verify your identity or understand the scope of your request.  You will not be required to create an account with us to submit a request or have it fulfilled.  We will require you to provide, at a minimum, your name, email address, and phone number. 

Authorized Agent:  Depending on your state of residence, you may also designate an authorized agent to make requests on your behalf by designating such an agent in writing or through a power of attorney. We will require the agent to provide us with proof that you have authorized the agent to make requests on your behalf prior to accepting requests from the agent.

Retention

We will process and store your information only for our legitimate business purposes, or as required by law.

To opt out of our email marketing, you can use the link provided at the bottom of each marketing message.  You may also send an unsubscribe request to [email protected]. If you opt out of our email marketing, we will still send you messages related to our transactions and relationship with you, such as order confirmations.
